New Title IX Regs Coming!

Controversial new Title IX regulations addressing sexual misconduct policies and procedures will take effect on August 14, 2020.   Key changes include a new definition of sexual harassment, a narrowed scope of investigation and reporting, a right to cross-examination, and a choice of evidentiary standards.  While proponents contend the revised rules will finally provide a level playing field for the accused, critics fear the rollback of Obama-era guidance may result in less reporting, fewer consequences and the erosion of victims’ rights.  Yet one outcome is certain.  The landscape for investigating and resolving sexual misconduct allegations at federally funded educational institutions is set to dramatically change.
